Draft Securities Industry Act, 2008

The Securities Commission of The Bahamas is pleased to issue the first draft of the proposed Securities Industry Act, 2008 (“the Draft Securities Act, 2008”) along with an Executive Summary, which outlines the key changes to each Part of the Securities Industry Act, 1999 (“current Act”), for industry-wide consultation and public review.

The Commission welcomes comments on the proposed new legislation. The review of the draft Act at this stage is to be treated as a preliminary review used to provide, what we feel, would be invaluable guidance and input into the Commission’s deliberations during the imminent drafting of the regulations. To address the concerns of industry, as well as provide the Commission with the advantage of a „preliminary‟ review, the consultation period originally provided will be extended. The draft Act will therefore remain issued for public consultation throughout the period of development of the regulations as well as for the period allowed for review of the regulations.
